ACCEPTANCE AND MODIFICATION OF THE TERMS OF USE
These terms of use aim to ensure the best use of the website secretinfusions.com, including its mobile version.
The Site aims to promote the brand and products of Secret Infusions. The use of the Site implies the user's acceptance of these terms of use and their commitment to comply with them.
The Site and the terms of use may be subject to changes and updates without notice.
Users can particularly enjoy the following Services: – purchasing products; – contacting customer service. Additionally, users can use our interactive services such as product reviews and ratings, expert questions/answers, comments, video posts, photos, recipes, and stories ("User Services"), and these terms govern the use of these User Services.
LINKS TO THIRD-PARTY SITES
The Site contains links to other websites/blogs/social networks of third parties ("Third-Party Sites") over which secret infusions has no control and cannot verify the content. It is therefore the user's responsibility to be aware of the commitments of the Third-Party Sites. Secretinfusions, in the name of Antonietta Impagnatiello, declines all responsibility for any link to another website that refers to the Site. The Site may be associated with such links, and its content not specifically authorized by Secret infusions.
INTELLECTUAL PROPERTY RIGHTS
The contents of the Site, such as, by way of example and not limited to, any logo, brand, domain names, images, photographs, dialogues, music, sounds, videos, codes, texts, and any other material in any format (the "Materials"), are the exclusive property of Secret Infusions, available exclusively to it, or licensed to Secret Infusions by the rightful owners, also in reference to credits and are protected by copyright and other applicable laws.
The Materials may not be reproduced, distributed, sold, transferred, or modified by the user in any way or form, even partially, without the prior consent of Secret Infusions.
Any use of the Materials by the user in violation of these terms of use and contrary to the law is illegal and will therefore be pursued by Secret Infusions using the appropriate tools provided by law.
Secret Infusions respects the intellectual property rights of third parties and all legal provisions to protect third parties' interests, as well as takes all possible measures with the means at its disposal to ensure that the Site does not violate protected rights. However, if it is believed that the Site may violate any rights, Secret Infusions will proceed with the removal of the content in question after receiving a written notification from the verified copyright holder.
COOKIES
The Sites may contain "cookies" to allow users a better experience. Users who prefer not to receive cookies can set their browser to notify them of the presence of cookies and decide whether to accept them or not. The browser can also be set to automatically reject all cookies; in this case, however, the user may not be able to access all the services available on the Site. RESPONSIBILITY
Secret Infusions regularly updates its content on the Site to allow access and use of the Site in the best conditions for the user. However, it cannot guarantee the timeliness, accuracy, and completeness of the contents. The user is fully aware that the contents on the Site are indicative. Secret Infusions reserves the right to make changes to the Site at any time and cannot guarantee the user access to the entire Site at any time, without interruption, timely, securely, and without errors. Therefore, the user acknowledges and agrees that the Site and its contents are provided "as is" and may be temporarily inaccessible or contain defects that could affect navigation and the use of services.
LIMITATIONS OF LIABILITY
The user acknowledges and agrees that their access to and navigation of the Sites is entirely at their own risk and responsibility. Secret Infusions cannot be held responsible for damages to a user caused by third parties who have used the information published on the Site using unfair techniques. Secret infusions cannot be held responsible for any damage suffered by the user due to network characteristics and/or technical configurations. The user agrees to defend, indemnify, and hold harmless Secret Infusions from any claim, demand, loss, liability, cost, expense, obligation, and damage of any kind and nature, known and unknown, including any legal fees, arising from (a) the use and access to the Sites and User Services; (b) the violation of any term of these Terms of Use; (c) the breach of the above representations and warranties regarding the Materials; (d) the violation of any law or third-party rights (including but not limited to any copyright, intellectual property right, or privacy right); or (This indemnification obligation will apply even in the event of termination of these Terms of Use and the use of the Site and User Services.
Subject to mandatory legal provisions, Secret Infusions will not be liable for any loss or damage arising from or in any way related to the use or operation of the Site and User Services, including – without limitation – damages for business interruption, loss of profits, business interruption, loss of business information, and/or any other type of pecuniary loss.
Secret Infusions will also not be liable for any damage or injury resulting from the use or inability to use the material included on the Site or resulting from the conduct of other users who violate these terms of use.
REGISTRATION
Access and registration to the Sites and User Services are reserved exclusively for users over the age of 18.
The user agrees to provide the Personal Data required during registration, ensuring that they are updated, complete, and truthful and to update them promptly, keeping them confidential.
The user is responsible for safeguarding the password they use to access the Sites and User Services and for any activity or action that requires their password. False personal information will not be provided on the Sites or accounts created for anyone other than themselves without authorization.
APPLICABLE LAW
The Terms of Use are governed by Italian law, without regard to any conflict of laws provisions in the state or country of the user's residence. All actions, disputes, claims, or proceedings related to the Sites and User Services will be exclusively subject to the jurisdiction of the Court of Trieste.
General Conditions of Sale
The offer and sale of products through the secretinfusions.com website are governed by the following General Conditions of Sale. The General Conditions of Sale are formulated in accordance with the legislation on contracts concluded outside of business premises, in particular as provided by Legislative Decree 6 September 2005, n. 206 (Consumer Code).
Contract Parties
The contract parties are as follows:

– Customer: the final consumer, i.e., the natural person who acts for purposes unrelated to their business and professional activities, identified through the secretinfusions.com website, who has placed an order accepted by Secret Infusions.
Application and modification of the General Conditions of Sale
By placing an order as specified, the Customer declares to have read all the instructions provided during the purchase procedure and to accept the General Conditions of Sale in full. Secret Infusions reserves the right to change the General Conditions of Sale by giving notice on this page of the site. The General Conditions of Sale applicable are those in force at the time of placing an order. Any changes will be effective after publication on the site.
Site registration
Registration with a username and password is optional. If the Customer does not wish to register, they can still make a purchase: only the data necessary for delivery and any invoicing of an order will be requested.
Characteristics and prices of products or services
The images of the products may not perfectly represent their characteristics but differ in color, dimensions, and accessory products represented. All support information for purchasing is to be considered as generic informative material, not referable to the actual characteristics of a single product.
The products are offered at the price indicated on the site on the date an order is placed.
The prices include VAT, which will be detailed on the purchase invoice, where issued.
Prices do not include shipping and delivery costs, which are, however, indicated in the final section before placing an order and specified in the order confirmation sent via email to the Customer.
Placing orders
Orders are subject to minimum or maximum quantity limitations, and the products are offered within the stock availability limits.
Where existing, promotional codes proposed by Secret Infusions and its partners are valid only for the products and during the period indicated each time. Promotional codes are not refundable and are not cumulative. To take advantage of the discounts and/or offers associated with promotional codes, the promotional code must be entered in the appropriate space when validating an order on the site. In case of omission, an order cannot be canceled or renewed to consider the promotional code.
Orders from persons who have not reached the age of majority will not be accepted.
The steps for placing an order and concluding the purchase contract are clearly highlighted in the sequence of site pages through explanatory texts and graphics.
After payment confirmation, the order can no longer be canceled or modified.
Order receipt confirmation and acceptance
Upon receipt of an order, Secret Infusions will automatically send an order receipt confirmation via email, summarizing all the details of the order. Following the receipt of an order, Secret Infusions will verify the availability of the ordered product and only after such verification will communicate its acceptance of the order and the shipment of the product.
If Secret Infusions is unable to fulfill a received order, it will promptly inform the Customer.
The customer is not entitled to any compensation for damages or indemnity, nor any contractual or non-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance of an order.
Accepted payment methods
Secret Infusions accepts payment only through the following systems: – Credit card (American Express, Visa, or Mastercard); through the Stripe payment platform. The total amount of an order will be charged only at the time of the actual shipment of the products.
– PayPal: an online payment system that allows any company or consumer with an email address to send and receive payments, subject to registration. Payment is made through the PayPal payment platform.
Product shipment
Shipments and deliveries of products can also be made to countries other than Italy, San Marino, and Vatican City. Secret Infusions, (after verification with its logistics partner), will ship the products purchased exclusively to the destination specified in an order. Shipments to PO Boxes are not accepted.
Secret Infusions will ship the products ordered by the Customer, via courier, to the address provided by the Customer, typically within 72 working hours from the acceptance of the order. Delivery in Italy generally takes place within 4/5 working days. The times reported for the receipt of the goods are indicative.
Delivery costs, always borne by the Customer, are charged based on the rates indicated on the site during the payment procedure.
The recipient of the goods is responsible for paying taxes and customs duties provided for by the regulations in force in the destination country of the products. For deliveries outside of Italy, if subject to opening and inspection of the products by customs authorities, Secret Infusions cannot be held responsible in any way for the tampering and/or damage of the product.
The courier is responsible for delivery. Secret Infusions undertakes to collect any reports of non-delivery or delayed delivery of the products through Customer Service and, if necessary, to assist the Customer in protecting their rights as per the law.
Acceptance of the product by the customer
Any damage to the packaging and/or the product or the mismatch in the number of packages or indications must be immediately contested by placing a specific indication on the delivery document. By signing the courier document, the Customer attests to the real integrity of the product's exterior and the conformity of the delivery.
Any issues regarding the actual physical integrity, correspondence, or completeness of the products received must be reported within 10 working days from delivery by sending an email to vendite@secretinfusions.com
Right of withdrawal and return rules
In accordance with Legislative Decree 21 February 2014, n.21 implementing directive 2011/83/EU on consumer rights, the Customer can return the purchased product and obtain a refund of the actual purchase amount paid. The right of withdrawal can be exercised within 14 days from receiving the product as follows:

Before the end of the aforementioned period, the Customer must send a registered letter with return receipt to Secret Infusions or submit another explicit declaration to that effect. The communication can also be sent within the same period via email to vendite@secretinfusions.com

The Customer will then be contacted by Secret Infusions (or its logistics partner) to handle the return.
The product must be returned within 14 days from the date of receipt of the withdrawal communication.
The refund of the purchase price excludes shipping costs. If the value of the products has decreased due to handling other than what is necessary to determine the nature, characteristics, and functioning of the products (for example: damaged products, not properly or completely packaged, or missing or damaged parts such as components, elements, accessories, packaging materials, boxes, documentation, and/or other objects), Secret Infusions will refund the Customer the purchase amount less the value of such decrease. If the Customer returns products beyond the aforementioned period or if the products are opened and/or partially used and not suitable for return, the right of withdrawal does not apply, and Secret Infusions will return the purchased goods to the Customer, charging the shipping costs.
With the above limitations, Secret Infusions will refund the amount actually paid by the Customer within 14 days from the receipt of the withdrawal communication through a credit note to the original payment method used by the Customer to complete the order in question.
Governing Law and Jurisdiction
The sale of products and/or services takes place within the territory of the Italian State and is subject to the laws in force in the Italian Republic. The competent court for resolving any disputes will be the one provided for by the Italian legislation in force at the time of the contract conclusion.
